Acting for major banks, non-institutional lenders and corporate borrowers in real estate, development and construction financing transactions, Kirby is renowned for her technical skills and ability to apply a commercial lens to ensure expeditious and commercial outcomes for her clients.

Kirby advises her broad range of clients across all aspects of finance transactions, from due diligence and security documentation through to legislative compliance and complex advisory work, regularly advising on the disposal of real estate assets, including distressed asset sales on behalf of mortgagees and receivers.

A go-to practitioner in the area of personal property securities law, Kirby is frequently called upon by the firm’s SME and corporate client base to advise on compliance with the PPSA post implementation in Australia.

Kirby is also a member of Banking and Financial Services Law Association (BFSLA).

Real estate (borrower)

Acting for an unlisted property fund with respect to the acquisition and development financing for its purchase of a major shopping centre in Noosa.

Real estate (lender)

Acting for a ‘big four’ with respect to $60m in funding for a luxury Gold Coast real estate development, including certification as to presale coverage.

Corporate

Acting for a ‘big four’ with respect to $50m in facilities for a waste management facility operator and associated equipment.

Agribusiness

Acting for a ‘big four’ with respect to $173m in funding to a well established Australian agricultural company, including acquisition of the land and business assets of a major Macadamia processing facility in Bundaberg.

Hotels and pubs

Assisting a major Queensland bank with respect to a $67m portfolio of facilities for prominent hoteliers, including the freehold and business acquisition of three large pubs in South East Queensland.

Government

Advising the Queensland Rural and Industry Development Authority for the documentation and roll out of the Queensland Government’s $1b Covid-19 Jobs Support Loan Scheme.
