About the Conference

Now in its 26th year, McCullough Robertson’s Annual Construction Law Conference brings together legal and industry professionals to explore the key issues shaping project delivery across Australia.

This full-day program features expert insights, panel discussions and practical sessions focused on current legal developments, emerging risks and strategies you can apply in practice. Designed for both legal and commercial audiences, it offers a valuable opportunity to stay informed and connect with peers across the sector.

Attendees will be eligible to claim CPD points for full-day attendance, with networking to follow.

Through a mix of engaging session formats, the program will explore best-practice project delivery, emerging legal and commercial considerations, and the evolving risk landscape, with a focus on innovation, adaptability and future readiness.
Year in review

Our expert panel’s reflections on key cases, legislative changes and industry trends and developments over the past 12 months, with a focus on their implications for the future. This panel will equip delegates to look around corners during the delivery of their projects.

Current trends in rise and fall/escalation provisions

Price fluctuations driven by domestic and international economic and geopolitical factors continue to affect the delivery of major projects in Australia. In this session we will explore the increased prevalence of rise and fall and escalation clauses in construction contracts and other commercial agreements. We will discuss:

  • the macro-economic factors driving renewed demand for these clauses;
  • the risks and issues to consider (and available options) when preparing or analysing a rise and fall clause; and
  • practical tips on structuring an effective commercial solution when drafting clauses of this nature.
Interactive workshops

Led by our talented Construction Team members, we will facilitate an interactive workshop to apply some of the matters discussed in the formal presentations. A practical application of issues that we commonly encounter will be incorporated into the workshops so that delegates can take these learnings and apply them to their own projects.

AI and the Future of Construction

Faced with an unprecedented pipeline of major projects, AI presents both opportunities and risks for the Australian construction sector. We will explore how AI is being used (or could be used) in project delivery, claims and dispute resolution, and whether it is part of the solution to the industry’s productivity challenge. Our session will examine the legal and commercial implications of AI use as part of disputes and investigations, as well as in corporate governance and decision-making.

Beyond Boilerplate: Rethinking Liability and Indemnity Provisions in Construction Contracts

A forward-looking discussion on tailoring liability and indemnity provisions to suit increasingly complex project structures and shifting risk appetites.

“It was such a rewarding couple of days, filled with invaluable insights and opportunities to connect with your wonderful team. The lunch you hosted was absolutely delightful, and I really appreciated the warm hospitality extended. Your team were incredibly lovely and friendly, making the experience all the more enjoyable.”
