McCullough Robertson recently received a highly anticipated judgment from the NSW Land and Environment Court, confirming that the development appeal commenced by our client, Lotus Development Management Pty Ltd (‘Lotus’), was upheld.
The appeal concerned North Sydney Council’s decision to refuse a development application lodged by Lotus in September 2021, seeking approval for the demolition of an existing (rundown) two-storey residential flat building and construction of a four-storey residential flat building at 107 High Street, North Sydney. Dealing with multiple contentions, which necessitated the engagement and expertise of numerous experts, our Planning & Environment team’s efforts to ensure every contention was effectively quashed has resulted in a very satisfying victory for our client.
