McCullough Robertson has successfully assisted Greenline Developments in achieving the dedication of a laneway in Annandale as a public road by Inner West Council, 138 years after the original subdivision of the Annandale Estate in 1887.
The title to the laneway, was registered in the name of the original proprietor despite having been dedicated by virtue of the common law prior to 1920. Following a detailed advice from us, this position was accepted by the Council who then formally dedicated the laneway under section 16 of the Roads Act 1993. This outcome is a significant milestone for Greenline Developments’ upcoming project, confirming legal rear lane access for the development and benefiting neighbouring properties with shop fronts on Parramatta Road. It also puts an end to a 20-year long dispute over the status of the rear lane.
Our Planning and Environment team advised Greenline Developments on the facilitation of the road dedication and acted in the subsequent Class 1 Appeal.
